Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Heavony mobile app, website, and related services (the “Service”), operated by Heavony (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.
2. Workspaces & roles
The Service is organised into workspaces. The person who creates a workspace, and the admins they designate, control its members, roles, and content. If you join a workspace created by someone else, that workspace’s owner may manage and access content within it.
3. Acceptable use
You agree not to:
- Break the law or infringe the rights of others.
- Upload malware or attempt to disrupt, overload, or gain unauthorised access to the Service.
- Reverse engineer, resell, or misuse the Service except as permitted by these Terms.
- Send spam or unsolicited messages, or use booking and messaging features abusively.
- Use the Service to store or share unlawful, harmful, or objectionable content.
4. Your content
You retain ownership of the content you create in the Service (“Your Content”). You grant us a limited licence to host, process, and display Your Content solely to operate and improve the Service. You are responsible for Your Content and for having the rights needed to use it.
5. Subscriptions & billing
Some features require a paid subscription. Prices, plans, and billing cycles are shown in the app. Paid subscriptions renew automatically until cancelled, and payments are handled by our payment partners (Paystack and Stripe). Except where required by law, fees are non-refundable. You can cancel at any time, and your plan remains active until the end of the current billing period. We may change prices with reasonable notice.
6. Free trials
We may offer trials. Trial terms are shown at sign-up. If a trial ends without you choosing a paid plan, your workspace moves to our Free plan rather than being locked — you keep access to your data and can continue working within the Free plan’s limits, or upgrade at any time.
7. Booking payments
Workspaces can charge their own clients when those clients book an appointment. This section governs those payments. It does not apply to what you pay us for the Service, which is covered by section 5.
We are not the merchant. The workspace offering the service is the seller and merchant of record for every booking payment. We provide software; we do not sell, supply, or guarantee the underlying appointment. Payments are processed by Paystack and settle directly to the workspace’s own settlement account. Heavony does not receive, hold, or control client funds at any point.
If you are a workspace, you are responsible for: the accuracy of your prices; delivering the service booked; setting and honouring your own refund and cancellation policy; responding to disputes and chargebacks raised against you; and any tax arising on your sales. You must connect a settlement account you are legally entitled to receive money into.
If you are a client booking an appointment, your contract for that appointment is with the workspace, not with Heavony. Refunds, rescheduling and cancellations are governed by that workspace’s policy, and refund requests should be raised with them directly. Where a workspace issues a refund through the Service, the money returns to the payment method used, which can take several days depending on your bank or mobile-money provider.
Deposits and holds. Where a workspace takes a deposit, the balance is payable to that workspace directly and is outside the Service. A booking awaiting payment reserves its slot for a short window; if payment is not completed in that window, the booking is cancelled and the slot is released.
Our fee. Where we charge a platform fee on booking payments, it is disclosed in the app before you enable paid bookings and is deducted at the time of the transaction. Payment processing fees are set by Paystack, not by us.
We may suspend paid bookings for a workspace where we reasonably suspect fraud, unlawful use, or a material breach of these Terms.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Heavony and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or the Service except the limited right to use it as permitted here.
9. Third-party services
The Service integrates with third parties (for example, payment, sign-in, and messaging providers). Your use of those integrations may be subject to their own terms, and we are not responsible for third-party services.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or its users. On termination, your right to use the Service ends; certain provisions survive.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the maximum extent permitted by law, Heavony will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You agree to indemnify and hold Heavony harmless from claims arising out of Your Content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
14. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. We will post the updated Terms here and revise the “Last updated” date; material changes may be notified in the app or by email. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Ghana, without regard to conflict-of-laws rules. Courts located in Ghana will have jurisdiction over disputes, except where applicable law provides otherwise.
